Intellectual Property Office – Bureau of Legal Affairs sustains Eddie Bauer, Inc.’s Opposition against Joaquin Ng, Jr.’s Trademark Application for the mark “EDDIE BAUER WITHIN A RECTANGULAR DEVICE”
In a case handled by the Firm representing Eddie Bauer, Inc., the Bureau of Legal Affairs - Philippine Intellectual Property Office (“BLA”) rendered a Decision in June 2012 stating that the use of the “EDDIE BAUER” mark by a certain Philippine-based individual is tainted with fraud and bad faith.

WIPO Transfers Disputed Domain Names for "WINSTON" to Japan Tobacco, Inc.
In a case handled by our Firm, the World Intellectual Property Organization ("WIPO") Arbitration and Mediation Center issued a Decision in July 2012 ordering the transfer of the domain names "winston.ph" and "winston.com.ph" (the "Disputed Domain Names") from an unauthorized registrant to Japan Tobacco, Inc. ("JTI").

In a summary judgment dated February 29, 2012, Branch 211 of the Regional Trial Court of Mandaluyong City dismissed for lack of merit the complaint for trademark infringement and unfair competition filed by accounting firm Stichting BDO (Stichting) against the country's largest banking institution Banco De Oro Unibank, Inc.

Court of appeals sustains CEMEX’S opposition to Supra Systems Trademark application for CEMEXTRA
In a case handled by our Firm on behalf of CEMEX S.A.B. DE CV ("Cemex"), the Court of Appeals, in its Decision dated 04 December 2012, sustained the Decision of the Director General of the Philippine Intellectual Property Office dated 03 December 2009. The 03 December 2009 Decision affirmed the Bureau of Legal Affairs' Decision dated 12 January 2009 sustaining Cemex's opposition and consequently rejecting Supra Systems (Phils.), Inc.'s ("Supra Systems") application for the registration of its confusingly similar mark "CEMEXTRA".

In a case handled by our Firm, the Bureau of Legal Affairs (BLA) of the Intellectual Property Office of the Philippines (IPO) issued Decision No. 2009-53 dated April 24, 2009 granting Banco de Oro Unibank, Inc.’s (BDO) petition for cancellation against Stichting BDO (Stichting), and ordered the cancellation of Stichting’s trademark registration for the mark “BDO & Design”.
- IPO Director General Sustains CEMEX's Opposition to Supra Systems' Trademark Application for CEMEXTRA
The case arose from a trademark application filed by local company Supra Systems for the mark “CEMEXTRA”. Cemex, one of the world’s largest cement manufacturers, is also the registered owner of numerous registrations for the name and mark “CEMEX”. Cemex opposed Supra Systems’ application on the ground that it is confusingly similar to its name and marks. Cemex uses its mark on cement and cement products while Supra Systems applied for registration of the mark “CEMEXTRA” for building materials.
- Trial Court Denies Pfizer’s Motion for Reconsideration
The Order arose from a patent infringement case filed by Pfizer and Warner Lambert against Unilab and Therapharma wherein they alleged that the latter companies infringed Warner Lambert’s patent over Atorvastatin Calcium, the generic name of the best selling anti-cholesterol drug "Lipitor".
